Die Eidgenössische Elektrizitätskommission (ElCom) hat die Netznutzungstarife 2010 und die Energietarife der Jahre 2009 und 2010 von Repower überprüft. Wie Repower am 4. Februar 2015 und am 2. März 2015 mitgeteilt hat, wurde durch die ElCom in Bezug auf die Energietarife 2009 und 2010 eine Teilverfügung erlassen, gegen welche Repower Beschwerde beim Bundesverwaltungsgericht erhoben hat. Das entsprechende Verfahren ist noch hängig.
Nun hat die ElCom das Verfahren über die Netznutzungstarife 2010 abgeschlossen. Die von Repower für das Tarifjahr 2010 geltend gemachten Betriebs- und Verwaltungskosten wurden dabei ohne Anpassungen akzeptiert. Bei den geltend gemachten Kapitalkosten für das Tarifjahr 2010 führte die Untersuchung der ElCom im Wesentlichen zu einer Bestätigung der Werte der Repower mit einzelnen Korrekturen und Anpassungen, welche für Repower nachvollziehbar sind und akzeptiert werden. Bei der Berechnung des Nettoumlaufvermögens ist ein Punkt noch in gerichtlicher Klärung im vor Bundesverwaltungsgericht hängigen Verfahren der Energietarife 2009 und 2010. Daher kann heute auch noch keine definitive Aussage über eine allfällige Unter- bzw. Überdeckung für das Tarifjahr 2010 und die folgenden Jahre gemacht werden.
Repower ist mit dem Ausgang des Verfahrens im Bereich Netz zufrieden, schafft er doch die im heutigen schwierigen Umfeld dringend nötige Rechtssicherheit für künftige Investitionen. Repower investiert zur Sicherstellung der Versorgungssicherheit jährlich rund 20 Millionen Franken in ihre Verteilnetze in Graubünden. Im Zusammenhang mit der Energiestrategie 2050 und dem starken Zubau an dezentralen Strom-Einspeisungen (vor allem Photovoltaik) werden zusätzliche Investitionen in die Verteilnetze erforderlich.

ElCom ha concluso l’esame delle tariffe per l’utilizzo della rete di Repower
La Commissione federale dell’energia elettrica (ElCom) ha esaminato le tariffe per l’utilizzo della rete applicate da Repower nel 2009 e nel 2010. Repower aveva informato il 4 febbraio 2015 e il 2 marzo 2015 sulla decisione parziale di ElCom in relazione alle tariffe dell’energia 2009 e 2010. Contro tale decisione Repower aveva presentato ricorso al Tribunale amministrativo federale. La rispettiva procedura è ancora in corso.
Ora ElCom ha chiuso la procedura sulle tariffe per l’utilizzo della rete. I costi d’esercizio e amministrativi esposti da Repower nel tariffario del 2010 sono stati accettati senza adeguamento. Per quanto attiene ai costi di capitale per l’anno tariffario del 2010, la ricerca di ElCom consente in sostanza di confermare i valori esposti da Repower, apponendo singole correzioni e modifiche, che Repower considera giustificabili. Nel calcolo del patrimonio netto (patrimonio di proprietà dell’impresa) è ancora in corso un chiarimento giuridico presso il Tribunale amministrativo federale nell’ambito del procedimento sulle tariffe dell’energia 2009 e 2010. Per questo motivo non è ancora possibile esprimersi definitivamente sulla copertura finanziaria per l’anno tariffario del 2010 e per gli anni successivi.
Repower è soddisfatta dell’esito della procedura nel campo delle reti, in quanto si è creata la necessaria stabilità giuridica per operare futuri investimenti in un contesto difficile. Ogni anno Repower investe circa 20 milioni di franchi per garantire l’efficacia della sua reta di distribuzione nei Grigioni. Nuovi investimenti nella rete sono inoltre necessari nell’ambito della strategia energetica 2050 e del forte potenziamento dell’immissione decentralizzata (in particolare impianti fotovoltaici) di energia elettrica.

ElCom completes review of Repower grid usage tariffs
The Federal Electricity Commission (ElCom) has examined Repower’s 2010 grid usage tariffs and its 2009 and 2010 energy tariffs. As Repower announced on 4 February and 2 March 2015, ElCom issued a partial ruling with respect of the 2009 and 2010 energy tariffs, to which Repower lodged an objection with the Federal Administrative Court. The proceedings in connection with this matter are still pending.
Now ElCom has completed the review of 2010 grid usage tariffs. It has accepted the operating and administrative costs asserted by Repower for the 2010 tariff year without adjustment. As for the costs of capital claimed for the 2010 tariff period, ElCom’s review has essentially confirmed the figures provided by Repower, with only isolated corrections and adjustments necessary that Repower can understand and accept. One point regarding the calculation of net working capital is still being clarified in the courts in the pending Federal Administrative Court proceedings relating to Repower’s 2009 and 2010 energy tariffs. For this reason it is still not possible to make any firm statement about whether there was a shortfall or surplus cover for the 2010 tariff period and subsequent years.
Repower is satisfied with the outcome of the review of grid usage tariffs, as it helps provide legal security with regard to future investment, urgently needed in the difficult environment that currently prevails. Repower invests around CHF 20 million a year in its Graubünden distribution grids to assure security of supply, and additional investment in distribution grids will be required in connection with the federal government’s 2050 energy strategy and efforts to substantially increase feed-in from decentralised generation (especially photovoltaic sources).
