Decision of the Swiss Federal Court on the compensation principles of southern approaches
In its judgement published today, the Swiss Federal Court has decided on six pilot cases in Gockhausen, that January 01, 1961 applies as reference date for claims for compensation for property affected by southern approaches as well.

In addition, the Swiss Federal Court has decided on principles for compensation of landowners whose property will be overflown directly by southern approaches.

This judgement of the Swiss Federal Court is positive for Flughafen Zürich AG. With this decision, important questions regarding indemnification for formal expropriations due to aircraft noise have been clarified in the last resort and therewith legal certainty has increased decisively. Flughafen Zürich AG estimated the total costs associated with aircraft noise to CHF 840.6 million so far. Until the present judgement, this estimate was linked to a high level of uncertainty regarding the final court ruling on some questions. The present judgement has confirmed the central assumptions of the previous estimate, and so far, the estimation itself in substantial parts. The detailed impact of this judgement on the estimated noise-related costs is further analyzed.
