Bekanntgabe des Basiszinssatzes zum 1. Januar 2014: Basiszinssatz vermindert sich auf -0,63 %

Die Deutsche Bundesbank berechnet nach den gesetzlichen Vorgaben des § 247 Abs. 1 BGB den Basiszinssatz und veröffentlicht seinen aktuellen Stand gemäß § 247 Abs. 2 BGB im Bundesanzeiger.

Der Basiszinssatz des Bürgerlichen Gesetzbuches dient vor allem als Grundlage für die Berechnung von Verzugszinsen, § 288 Absatz 1 Satz 2 BGB. Er verändert sich zum 1. Januar und 1. Juli eines jeden Jahres um die Prozentpunkte, um welche seine Bezugsgröße seit der letzten Veränderung des Basiszinssatzes gestiegen oder gefallen ist. Bezugsgröße ist der Zinssatz für die jüngste Hauptrefinanzierungsoperation der Europäischen Zentralbank vor dem ersten Kalendertag des betreffenden Halbjahres.

Der Festzinssatz für die jüngste Hauptrefinanzierungsoperation der Europäischen Zentralbank am 30. Dezember 2013 beträgt 0,25 %. Er ist seit dem für die letzte Änderung des Basiszinssatzes maßgeblichen Zeitpunkt am 1. Juli 2013 um 0,25 Prozentpunkte gefallen (der Festzinssatz der letzten Hauptrefinanzierungsoperation im Juni 2013 hat 0,50 % betragen).

Hieraus errechnet sich mit dem Beginn des 1. Januar 2014 ein Basiszinssatz des Bürgerlichen Gesetzbuchs von -0,63 % (zuvor -0,38 %).

Der neue Basiszinssatz wird in der Ausgabe des Bundesanzeigers vom 31. Dezember 2013 bekannt gegeben.

Announcement of the basic rate of interest as of 1 January 2014: basic rate of interest reduced to -0.63%

The Deutsche Bundesbank calculates the basic rate of interest pursuant to section 247 (1) of the German Civil Code (Bürgerliches Gesetzbuch) and publishes its current level in the Federal Gazette (Bundesanzeiger) pursuant to section 247 (2) of the German Civil Code.

The basic rate of interest as laid down by the German Civil Code serves primarily as a basis for calculating default interest (section 288 (1) sentence 2 of the German Civil Code). It changes on 1 January and 1 July each year by the percentage points by which the reference rate has risen or fallen since the last change in the basic rate of interest. The reference rate is the interest rate for the most recent main refinancing operation of the European Central Bank prior to the first calendar day of the six-month period concerned.

The fixed interest rate for the most recent main refinancing operation of the European Central Bank on 30 December 2013 was 0.25%. Since 1 July 2013, the relevant date for the last change in the basic rate of interest, the fixed interest rate has fallen by 0.25 percentage point (the fixed interest rate for the last main refinancing operation in June 2013 stood at 0.50%).

Beginning on 1 January 2014, this amounts to a basic rate of interest of -0.63% pursuant to the German Civil Code (down from -0.38%).

The new basic rate of interest will be announced in the Federal Gazette of 31 December 2013.
