Die Eidgenössische Finanzmarktaufsicht FINMA hat Ende August 2014 ein Enforcement-Verfahren gegen die Banque Privée Espírito Santo SA eröffnet. Gegenstand der Untersuchung ist der Vertrieb von Wertpapieren und Finanzprodukten der Gruppe Espirito Santo.
Die FINMA geht mit ihrem Enforcement-Verfahren der Frage nach, welche Rolle die sich in freiwilliger Liquidation befindliche Schweizer Gesellschaft Banque Privée Espírito Santo SA beim Vertrieb von Wertpapieren und Finanzprodukten der Gruppe Espirito Santo gespielt hat und ob dabei gegen das Aufsichtsrecht verstossen wurde. Untersucht wird auch der Einfluss der Eigner der Bank auf die Vorgänge in der Schweiz. Die FINMA setzte einen Untersuchungsbeauftragten ein, der die entsprechenden Sachverhalte abklären wird.
Weitere Einzelheiten zum laufenden Enforcement-Verfahren gibt die FINMA zum jetzigen Zeitpunkt nicht bekannt.

La FINMA ouvre une procédure d'enforcement à l'encontre d'Espírito Santo
A la fin du mois d'août 2014, l'Autorité fédérale de surveillance des marchés financiers FINMA a ouvert une procédure d'enforcement à l'encontre de la Banque Privée Espírito Santo SA. Les investigations portent sur la distribution de titres et de produits financiers du groupe Espírito Santo.
Par sa procédure d'enforcement, la FINMA cherche à déterminer quel rôle a joué la société suisse Banque Privée Espírito Santo SA, laquelle se trouve actuellement en situation de liquidation volontaire, dans la distribution de titres et de produits financiers du groupe Espírito Santo et si elle a ce faisant violé le droit de la surveillance. L'investigation porte également sur l'influence des propriétaires de la banque sur les processus en Suisse. La FINMA a nommé un chargé d'enquête qui clarifiera les faits.
La FINMA ne peut pour l'instant fournir davantage d'informations au sujet de la procédure d'enforcement en cours.

La FINMA apre un procedimento a carico di Espirito Santo
L'Autorità federale di vigilanza sui mercati finanziari FINMA ha avviato a fine agosto 2014 un procedimento di enforcement a carico della Banque Privée Espírito Santo SA. L'oggetto dell'indagine è costituito dalla distribuzione di titoli e prodotti finanziari del gruppo Espirito Santo.
La FINMA ha avviato un procedimento di enforcement al fine di accertare quale sia stato il ruolo svolto dalla società svizzera Banque Privée Espírito Santo SA, posta in liquidazione volontaria, ai fini della distribuzione di titoli e prodotti finanziari del gruppo Espirito Santo, e se in tale contesto siano state violate norme del diritto di vigilanza. L'indagine concerne anche l'influsso esercitato dai proprietari della banca sulle operazioni effettuate in Svizzera. La FINMA ha designato un incaricato dell'inchiesta, che provvederà ad accertare la fattispecie del caso.
Al momento la FINMA non fornisce ulteriori particolari circa il procedimento di enforcement in corso.

FINMA initiates proceedings against Espirito Santo
The Swiss Financial Market Supervisory Authority FINMA initiated enforcement proceedings against Banque Privée Espírito Santo SA at the end of August 2014. The focus of the investigation is the distribution of securities and financial products of the Espirito Santo Group.
FINMA's enforcement proceedings will examine the role played by the Swiss company Banque Privée Espírito Santo SA, which is undergoing voluntary liquidation, in the distribution of securities and financial products of the Espirito Santo Group and whether breaches of supervisory law occurred. The influence of the owners of the bank on procedures in Switzerland will also be examined. FINMA has appointed an independent third party to clarify the circumstances surrounding these issues.
FINMA will give no further details on the ongoing enforcement proceedings at this time.
