BA - IS-Anschlagspläne in Europa vereitelt Freitag, 31. Oktober 2014 - 10:14
Bern, 31.10.2014 - Die Bundesanwaltschaft (BA) hat Ende März 2014 drei irakische Staatsangehörige und mutmassliche Unterstützer der kriminellen Organisation Islamischer Staat (IS) verhaftet. Sie werden verdächtigt, einen terroristischen Anschlag in Europa geplant zu haben.
Ausgelöst wurde die seit März 2014 laufende Strafuntersuchung der BA ursprünglich durch nachrichtendienstliche Informationen, die der Nachrichtendienst des Bundes (NDB), an die Bundeskriminalpolizei (BKP) weitergeleitet hatte. Es besteht der Verdacht der Unterstützung des Islamischen Staates (IS), einer kriminellen Organisation, der Gefährdung durch Sprengstoffe und giftige Gase in verbrecherischer Absicht, der strafbaren Vorbereitungshandlungen, der Pornografie sowie der Förderung der rechtswidrigen Ein- und Ausreise sowie des rechtswidrigen Aufenthalts. Die drei Beschuldigten befinden sich seit Ende März 2014 in Untersuchungshaft.
Das vorzeitig in den Medien bekannt gewordene Verfahren wurde bisher nicht offiziell bestätigt, um laufende Ermittlungsergebnisse im In- und Ausland nicht zu gefährden. Die Ermittlungen zielten bisher auch darauf ab, mögliche Komplizen bzw. Netzwerke im In- und Ausland aufzudecken.
Aufgrund der internationalen Verflechtung dieses Falles zählt die BA auch auf die Kooperation anderer Staaten. So hat die BA in den letzten Monaten mehrere Rechtshilfeersuchen an verschiedene europäische Partnerbehörden geschickt.
Die BA arbeitet in diesem Fall auch eng mit den US-amerikanischen Justizbehörden zusammen. Dazu wurde eine gemeinsame Ermittlungsgruppe aus Ermittlern der BKP und des FBI ins Leben gerufen. Diese Form der Zusammenarbeit beider Länder gründet auf dem seit 2006 geltenden „Operative Working Arrangement" (OWA) zwischen der Schweiz und den USA im Bereich der Strafverfolgung terroristischer Aktivitäten. Der vorliegende Fall ist das erste Anwendungsbeispiel auf der Basis des OWA.
Mit dem Instrument der gemeinsamen Ermittlungsgruppe können die gewonnenen Erkenntnisse aus den Ermittlungen laufend ausgetauscht werden. Grundsatz des OWA ist jedoch die strikte Einhaltung der Rechtshilfevorschriften, d.h. das Abkommen verhindert jegliche Umgehung des Rechtshilfeweges und garantiert somit den Rechtsschutz der Betroffenen. Es verweist zudem auf den Staatsvertrag zwischen der Schweiz und den USA über die gegenseitige Rechtshilfe in Strafsachen, der nicht angetastet wird.
Weitere Angaben zur laufenden Strafuntersuchung können aus ermittlungstaktischen Gründen nicht gemacht werden.
Die BA führt gegenwärtig rund 20 Verfahren im Bereich des radikalen Dschihadismus, darunter fünf mit Syrien-Bezug. Nähere Angaben zu den Verfahren werden mit Blick auf das Amts- und Untersuchungsgeheimnis nicht gemacht.

Des projets d’attentat de l’EI en Europe déjoués
Berne, 31.10.2014 - Le Ministère public de la Confédération (MPC) a incarcéré à la fin du mois de mars 2014 trois ressortissants irakiens, soutiens présumés de l’organisation criminelle Etat islamique (EI). Ils sont soupçonnés d’avoir planifié un attentat terroriste en Europe.
Menée depuis mars 2014, l'enquête pénale du MPC avait été déclenchée initialement sur la base d'informations secrètes que le Service de renseignement de la Confédération (SRC) avait transmises à la Police judiciaire fédérale (PJF). Celles-ci font état de soupçons de soutien à l'organisation criminelle Etat islamique (EI), d'emploi, avec dessein délictueux, d'explosifs ou de gaz toxiques, d'actes préparatoires délictueux, de pornographie et d'incitation à l'entrée, à la sortie ou au séjour illégaux. Les trois prévenus sont en détention provisoire depuis fin mars 2014.
Rendue publique à un stade précoce, l'affaire n'avait pas été confirmée officiellement jusqu'ici pour ne pas mettre en jeu les résultats de l'enquête en cours en Suisse et à l'étranger. L'instruction visait jusqu'à présent à dépister d'éventuels complices ou réseaux en Suisse et à l'étranger.
Vu la dimension internationale de cette affaire, le MPC compte aussi sur la coopération d'autres Etats. Il a ainsi envoyé ces derniers mois plusieurs demandes d'entraide judiciaire à diverses autorités européennes.
Dans cette affaire, le MPC travaille également étroitement avec les autorités judiciaires des Etats-Unis, une équipe commune d'enquête composée d'enquêteurs de la PJF et du FBI ayant été mise en place. Cette forme de coopération entre les deux pays est prévue par l' « Operative Working Arrangement » (OWA) conclu par la Suisse et les Etats-Unis dans le domaine de la poursuite pénale des activités terroristes et en vigueur depuis 2006. La présente affaire est le premier exemple d'application de ce texte.
Le dispositif de l'équipe commune d'enquête permet d'échanger en continu les renseignements obtenus au cours de l'enquête. L'« OWA » prévoit cependant le principe du strict respect des dispositions de l'entraide judiciaire : cet accord empêche ainsi tout contournement de la voie de l'entraide judiciaire et garantit par conséquent la protection juridique des personnes concernées. Il renvoie en outre au traité d'Etat entre la Suisse et les Etats-Unis sur l'entraide judiciaire en matière pénale, qui n'est pas modifié par l'accord précité.
Dans l'intérêt de l‘enquête, il n'est pas possible pour l'instant de communiquer d'autres informations sur l'instruction pénale en cours.
Le MPC mène actuellement une vingtaine de procédures dans le domaine du djihadisme radical, dont 5 en lien avec la Syrie. Compte tenu du secret de fonction et du secret de l'instruction, le MPC ne communique aucune information supplémentaire sur les procédures qu'il instruit.

Sventato un progetto di attentato dello Stato islamico
Berna, 31.10.2014 - A fine marzo, il Ministero pubblico della Confederazione (MPC) ha arrestato tre cittadini iracheni, presunti simpatizzanti dello Stato islamico (IS), sospettati di aver pianificato un attacco terroristico in Europa.
L'inchiesta penale del MPC in atto dallo scorso mese di marzo era scattata in seguito a informazioni trasmesse dal Servizio delle attività informative della Confederazione (SIC) alla Polizia giudiziaria federale (PGF). Tre persone in carcerazione preventiva da fine marzo sono indagate per sostegno al gruppo «Stato islamico» (IS), organizzazione criminale, uso delittuoso di materie esplosive o gas velenosi, atti preparatori punibili, pornografia e incitazione all'entrata, alla partenza o al soggiorno illegali.
Il procedimento, reso pubblico prematuramente dai media, non era ancora stato confermato ufficialmente per non compromettere l'esito delle indagini in corso nel nostro Paese e all'estero. Nel mirino delle attività investigative in corso vi erano eventuali complici e collegamenti in Svizzera e all'estero.
Tenuto conto del carattere internazionale del caso, il MPC si avvale anche della collaborazione di altri Stati e negli ultimi mesi ha trasmesso una serie di domande di assistenza giudiziaria a varie autorità partner europee.
In questa vicenda il MPC collabora inoltre strettamente con le autorità giudiziarie statunitensi in un gruppo inquirente congiunto, costituito ad hoc con inquirenti della PGF e del FBI. Questa forma di collaborazione tra Svizzera e Stati Uniti si basa sull'accordo volto a perseguire le attività terroristiche denominato «Operative Working Arrangement» (OWA), concluso tra i due Paesi e in vigore dal 2006. L'attuale inchiesta rappresenta il primo caso di concretizzazione dell'accordo.
Lo strumento del gruppo inquirente congiunto consente lo scambio continuo d'informazioni sui riscontri delle rispettive indagini tra le autorità inquirenti. L'OWA si fonda però sul rigoroso rispetto delle disposizioni applicabili in materia di assistenza giudiziaria, impedendo qualsiasi elusione della relativa procedura e tutelando così i diritti di difesa delle persone interessate. L'accordo rimanda inoltre al Trattato fra la Confederazione Svizzera e gli Stati Uniti d'America sull'assistenza giudiziaria in materia penale, integralmente applicato.
Per ragioni di tattica investigativa, non è possibile fornire maggiori indicazioni sulle indagini in corso.
Il MPC oggi conduce una ventina di procedimenti nell'ambito dell'estremismo jihadista. Cinque sono in rapporto con la Siria. In virtù del segreto d'ufficio e del segreto istruttorio non si rilasciano maggiori informazioni circa i procedimenti.

Planned IS attack in Europe foiled
Bern, 31.10.2014 - At the end of March 2014, the Office of the Attorney General of Switzerland (OAG) arrested three Iraqi citizens suspected of providing support to the criminal organisation known as the Islamic State (IS). They are thought to have been planning a terrorist attack in Europe.
The criminal investigation, which the OAG has been conducting since March 2014, was begun in response to information passed on to the Federal Criminal Police (FCP) by the Federal Intelligence Service (FIS). The suspected offences include supporting the Islamic State (IS), which is a criminal organisation, misuse of explosives and toxic gases with criminal intent, acts preparatory to criminal offences, pornography, and encouraging illegal entry to, exit from and residence in Switzerland. The three suspects have been held in pre-trial detention since the end of March 2014.
Although reports on this matter have already appeared in the media, the investigation has not been officially confirmed until today so as not to jeopardise the outcome of enquiries still ongoing in Switzerland and abroad. These enquiries aim to identify possible accomplices and to uncover networks in Switzerland and abroad.
Due to the international dimension of the case, the OAG has also called on the assistance of other states. In recent months, for example, the OAG has made several requests for mutual assistance to various European partner authorities.
The OAG has also been working closely on the case with American law enforcement authorities. A joint investigation team comprising officers from the FCP and the FBI has been set up. This form of cooperation between the two countries is based on the Operative Working Arrangement (OWA) between Switzerland and the USA on Law Enforcement Cooperation on Counterterrorism, which came into effect in 2006. The current case is the first practical example of cooperation based on the OWA.
By deploying a joint investigation team, the findings obtained from the investigations can be exchanged on a daily basis. A key aim of the OWA, however, is to ensure strict compliance with the rules on mutual assistance, i.e. the OWA prevents any circumvention of mutual assistance procedures and thus guarantees the legal rights of the persons concerned. It also makes reference to the international treaty between Switzerland and the USA on mutual legal assistance in criminal matters, which is not affected by the Arrangement.
No further details relating to this particular criminal investigation can be provided for operational reasons.
The OAG is currently conducting around 20 proceedings concerned with militant jihadism, including five related to Syria. Further details of these cases cannot be released due to official secrecy and the confidentiality of the investigations.
