New Financial Services Act and Financial Institutions Act: SIX calls for fundamental adjustments

 

SIX in its submission on consultation generally welcomes the legislative project of the Financial Services Act (FSA) and Financial Institutions Act (FinIA). However, SIX rejects disproportionate tightening vis-à-vis the existing and functioning Swiss law and European regulation. If the FSA/FinIA is implemented, the independent regulatory body SIX Exchange Regulation will apply to be a prospectus review body as required by the FSA.

SIX begrüsst in ihrer Vernehmlassungseingabe grundsätzlich das Gesetzgebungsprojekt des Finanzdienstleistungs- (FIDLEG) und Finanzinstitutsgesetzes (FINIG). SIX lehnt jedoch unverhältnismässige Verschärfungen gegenüber dem bestehenden funktionierenden Schweizer Recht und der europäischen Regulierung ab. Sollte das FIDLEG/FINIG zur Umsetzung gelangen, wird sich die unabhängige Regulierungseinheit SIX Exchange Regulation für die im FIDLEG vorgesehene Prüfstelle für Prospekte bewerben.

 

Nouvelle loi sur les services financiers et les établissements financiers: SIX exige des adaptations fondamentales

SIX accueille en principe le projet de législation sur les services financiers (LSF) et les établissements financiers (LEFin) dans sa prise de position. SIX rejette en revanche les durcissements démesurés par rapport à un droit suisse qui fonctionne actuellement et à la réglementation européenne. Si la LSF/LEFin parvient à être mise en oeuvre, l’unité de réglementation indépendante SIX Exchange Regulation se porte candidate au poste d’organisme de vérification des prospectus prévu par la LSF.
